1. Introduction

Your Information. Your Rights. Our Responsibilities.

Amogavi Privacy Policy includes: types of collected information; explanation of how information is collected; purpose of collecting user data; how user data is used; any sharing of data with third parties and the purpose of such sharing; explanation of where and how user data is stored and protected; explanation of user options for controlling their data; how users can opt-out of data collection or request data removal; details about third-party services or APIs integrated into your app and how they handle user data; links to the privacy policies of third-party services; explanation of the use of cookies and similar tracking technologies; how users can manage cookie preferences; notification process for changes to the privacy policy; contact details for users to reach out with privacy-related concerns.

This policy applies to information we collect: on our Website and Application; in email, text, phone conversation, video interaction, and other electronic messages between you and our Website and Application; when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by: us offline or through any other means, including on any other website operated by Amogavi or any third party; any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website or Application.

2. Information Collected

Your personal information and account details. When you create a Amogavi account, we ask for your first and last name, email address, phone number, and address. You can also choose to enter your date of birth, weight, height, and other biometrics to improve your app experience.

Your payment information. When you pay for a Amogavi subscription, we use Stripe to collect, store, and process your payment information. Amogavi does not have access to your full credit card information, and we'll never ask you to share that information with us directly.

Your device information. Your computer, mobile device, and/or browser information (e.g., IP address, mobile device ID information, operating system, connection speed, bandwidth, browser type, referring/exit web pages, web page requests, cookie information, hardware attributes, software attributes).

Your health-related information. Such health information as necessary to properly provide the Services, including but not limited to, blood glucose data and diabetes status.

Your logs – meals, activities, notes. When using Amogavi, you'll likely add meal photos, titles, notes, and activities. You can also import sleep data, heart rate data, and activity data from your device. Access to this information is limited to those with a business need, like support team members, data scientists, product managers, or engineers.

Your glucose data, via your CGM and transmitter. Your blood glucose readings in the course of using the products and services provided through the Amogavi app, which track your blood glucose levels when you connect to a device that measures your glucose levels.

Your feedback and support requests. When you contact our Support or Member Experiences team, we retain the chat or email log as part of our records.

Your social media. Information about, and/or information found on, your pages and accounts with third-party websites, networks, platforms, servers, and applications (e.g., Facebook, Google Plus, LinkedIn).

3. How the Information is Collected

Directly from you when you provide it to us; automatically as you navigate through the Website or use our Application. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies; and from third parties, for example, our business partners.

4. Use of Information

We use the Personal Information and other data that you provide primarily as necessary to provide our Services, including, but not limited to: providing you with a personalized experience when you use our App; contacting you with information and notices related to our Services; to provide you with effective customer service; contacting you with special offers and other information we believe will be of interest to you; better understanding your needs and interests; security, credit, or fraud prevention purposes; improving the content, functionality, and usability of the App; improving our Services; contributing to research in the field of metabolic health; improving our marketing and promotional efforts; and any other purpose identified in an applicable privacy notice, click-through agreement, or other agreement or communication between you and us.

5. Where and How User Data is Stored

Your data will be stored on Google Compute Platform. This third-party service does not use or have access to your personal information for any purpose other than cloud storage and retrieval. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Our security practices currently include, but are not limited to: Multi-factor authentication for internal access to member data, IP whitelists, Encryption at rest, Code reviews for all code changes, The ability to quickly revoke access to member data as needed. The safety and security of your information also depend on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App or website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

6. How We Share and Disclose Your Data

We will share your data with third parties only under the following circumstances: You request or authorize us to share your data; The information is needed by our agents, vendors, or service providers to perform functions on our behalf; We are required to by law (for example, to comply with a search warrant, subpoena, or court order); If necessary and with your permission, we will share medical information you provide with an independent telemedicine service.

7. Data Export and Control

Amogavi retains member data on secure servers for the duration of its business relationship with the member, and for an indefinite period afterward. Amogavi is a steward of your data, and you have the right to ask us to delete it at any time.

What you can export & delete: 1. You can export your biometric data, activity logs, and other similar data in CSV, PDF format by logging on to your account in the app. 2. You can request that we delete all your identifiable data stored by Amogavi by emailing us at ruslan.konovalov@amogavi.com; we will verify that you are the one making this request. 3. Amogavi will comply with your request to delete your data no later than one month after you make your request unless more time is required to verify your identity.

What we can't delete: 1. Your payment history and details, including your billing address, are stored with our payment processors and saved for accounting and fraud prevention purposes. 2. Any data that is a part of your official medical records. Amogavi is not a healthcare provider and does not have the authority to modify or delete any information that is a part of an official medical record. 3. We cannot delete your data that may be stored with any third parties. 4. You'll need to reach out to those third parties for assistance removing your records from their services.

8. Third-Party Services

Analytic tools and services, which are sometimes offered by third parties, and which track, measure and/or generate information about a website’s or program’s traffic, sales, audience, and similar information, and which may be used for various reasons, such as, for example, statistical research, marketing research, and content ratings research, and conversion tracking. Google Analytics and Alexa are common examples of these types of technologies. Amogavi may also use other third-party analytic tools, services and data tracking or analytic technologies (e.g., deep linking, eTags, device fingerprinting or cross-device tracking).

Our Services may contain links to, or otherwise allow you to interact with, certain third-party websites, mobile applications, and services that are not owned or controlled by Amogavi (each a Third Party Service). We are not responsible for the privacy practices or the content of these Third Party Services, and we encourage you to read the terms and conditions and privacy policy of any such Third Party Service that you choose to use.

9. Cookies and Tracking

By visiting, accessing, registering with, or using the Site and/or the App, you acknowledge and agree in each instance that you are giving Amogavi permission to monitor or otherwise track your activities on the Site and/or the App, and that Amogavi may use the aforementioned technologies and/or other tracking, data aggregation, and data analysis technologies.

Cookies, which are small data files (e.g., text files) stored on the browser or device you use to view a website or message. They may help store user preferences and activity and may allow a website to recognize a particular browser or device. There are several types of cookies, including, for example, browser cookies, session cookies, and persistent cookies. Cookies may record information you access on one page of a website to simplify subsequent interaction with that website, or to help streamline your transactions on related pages of that website. Most major browsers are set up so that they will initially accept cookies, but you might be able to adjust your browser’s or device’s preferences to issue you an alert when a cookie is downloaded, or to block, reject, disable, delete, or manage the use of some or all cookies on your browser or device.

Flash cookies, which are cookies written using Adobe Flash, and which may be permanently stored on your device. Like regular cookies, Flash cookies may help store user preferences and activity and may allow a website to recognize a particular browser or device. Flash cookies are not managed by the same browser settings that are used for regular cookies.

Web beacons, which are pieces of code embedded in a website or email to monitor your activity on the website or your opening of the email, and which can pass along information such as the IP address of the computer or device you use to view the website or open the email, the URL page on which the web beacon is located, the type of browser that was used to access the website, and previously set cookie values. Web beacons are sometimes used to collect advertising data, such as counting page views, promotion views, or advertising responses. Disabling your computer’s, device’s, or browser’s cookies may prevent some web beacons from tracking or recording certain information about your activities.

Scripts, which are pieces of code embedded in a website to define how the website behaves in response to certain key or click requests sent by the user. Scripts are sometimes used to collect information about the user’s interactions with the website, such as the links the user clicks on. Scripts are often times temporarily downloaded to the user’s computer or device from the website server, active only while the user is connected to the Website and/or the App, and deactivated or deleted when the user disconnects from the Website and/or the App.

10. The Rights of Users

Users may exercise certain rights regarding their Data processed by the Owner. In particular, Users have the right to do the following: 1. Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data. 2. Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent. Further details are provided in the dedicated section below. 3. Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing, and obtain a copy of the Data undergoing processing. 4. Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected. 5. Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the processing of their Data. In this case, the Owner will not process their Data for any purpose other than storing it. 6. Have their Personal Data deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Data from the Owner. 7. Receive their Data and have it transferred to another controller. 8. Users have the right to receive their Data in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the Data is processed by automated means and that the processing is based on the User's consent, on a contract which the User is part of, or on pre-contractual obligations thereof. 9. Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

11. Notification Process for Changes to the Privacy Policy

We may modify this privacy policy from time to time. If we do, we will post the new privacy policy on our web page, and we'll be sure to alert you proactively via the email you provided to us.
